The Clause That Mattered
Four weeks into the 2023 WGA strike, the coverage had settled into its default frame: streamers vs. writers, residuals in the streaming era, Netflix's reported refusal to negotiate. The financial framing was legible. Audiences understood money. They understood the argument that writers deserved a bigger slice of a streaming pie that had made the studios rich.
The AI clause was harder to explain. So most people didn't try.
The WGA's demands on artificial intelligence — that studios couldn't use AI to write or rewrite literary material, that AI-generated content had to be disclosed, that writers' work couldn't be used to train AI systems without consent — read, in May 2023, like future-proofing. Speculative. Adjacent to the real fight. The real fight, the coverage suggested, was about money.
The writers knew the AI clause was about existence.
What the financial framing missed is the structure underneath it. Residuals are a mechanism for ensuring that the value created by writers flows back to them over time. The AI provisions were a demand for the same mechanism in a different register: that the pattern of creative labor — the accumulated knowledge of structure, voice, story architecture — couldn't simply be extracted, compressed into model weights, and returned as a competing product without acknowledgment or compensation.
The writers were fighting about whether the word "writer" would mean anything in ten years.
That's an uncomfortable argument to make in a labor context because it's speculative. Strikes work on legible, immediate grievances. "The thing we do may become valueless because the pattern of our labor will be used to build a replacement for us" is not a picket-sign slogan. It's also exactly what they were fighting about.
The clause they eventually won — no AI can write or rewrite literary material, disclosure required, training data protections — got reported as a partial victory, a foot in the door, something to build on. Which is accurate. It's also a description of a fight that recognized its own stakes more clearly than the coverage did.
The uncomfortable thing about the 2023 WGA strike, seen now, is how precisely the writers named the threat while the audience watched for a different reason. They weren't wrong to care about the residuals. But the AI clause was the one that was actually about the future.
Four weeks in, some things were already visible. Just not to everyone watching.
